Discorso di apertura Summer School Tor Vergata “Gino Gorla”

Di seguito si riporta il discorso di apertura pronunciato in occasione dell’apertura della Summer School Tor Vergata “Gino Gorla”, il 16 luglio 2018.

La Summer School Tor Vergata “Gino Gorla” è una manifestazione annuale organizzata da Juristor – Associazione dei Laureati di Giurisprudenza a Tor Vergata, nel quale due professori americani madrelingua impartiscono corsi di “American Law” e “Legal Writing in English”.

“We hold these truths to be self-evident: that all men are created equal; that they are endowed by their creator with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness.”

These words were pronounced in congress, on July 4th, 1776 by Thomas Jefferson and became part of the unanimous declaration of the thirteen United States of America, better known as “Declaration of Indipendence”.

From that moment on, every country in the world slowly started to feel that United States of America were the leading country for freedom and liberty, both in economics and in politics.

In particular, this “attention” for the sake of Justice led that country to principles that, even if originally developed by Europeans scholars, the continental countries wouldn’t develop for more than a century, as the right to a fair trial though cross examination and accusatory system.

On the other hand, United States have been the leading country not only for civil rights, but also in the business field. This is basically the reason why Legal writing in English is nowadays a fundamental notion that every student or young attorney that wishes to practice law in the globalization era should acquire. Every corporate arbitration or international business transaction finds in English the common language that let people coming from all over the world to face each other and to do business together. This is so true that comes to the point where being a corporate or business lawyer today implies much more to have a full understanding of English than to have a deep knowledge of the national law of a certain country.

This are part of the reasons we invited you here: this university understands these issues and wishes to provide its students and alumni with the chance to learn from your living voice what the law is in the U.S.A. and all the tricks of the legal writing techniques.

However, from my personal point of view, this is just part of the reason: all the other professors I had the chance to meet in Syracuse gave me the opportunity to understand not only a way to think law that is completely different, but also a different way of living, thinking and reasoning.

I was so excited about my discovery of the new world that I didn.’t want to keep it for myself, this was the purpose for witch I, Professor Sassani, Enrica Gallo, Gianluca Fiocco and others decided to create the association of the alumni called “Juristor”: we wanted to share the different experiences every one of us enjoyed and to increase the learing opportunities, not only for us, but for all the students and alumni that may be interested.

Therefore, I want to end this little speech by thanking all the people that made this first experience possible: first of all Prof. Giuseppe Novelli and Prof. Claudio Franchini, that I invite here to give their greetings to the class. I also want to thank all the silent people that for free helped us in all aspects of organization and promotion of this first edition of the Summer School.
